Professional Liability
Our Professional Liability Practice Group represents attorneys, architects, engineers, contractors, insurance agents and brokers, accountants, and other professionals in malpractice and breach of fiduciary duty actions.
We work regularly with our insurance company partners in drafting policy wordings, formulating risk profiles and providing assistance in the risk management of their insureds. Our attorneys regularly speak at continuing education seminars and company retreats and provide articles to both internal company and industry publications on emerging professional liability issues in Florida.
Working closely with insurance companies, we are very familiar with the various industry protocols that are required by insurance companies and third-party administrators. As a result, we have standardized procedures within our firm regarding the issuance of agreed-upon litigation plans, status communications to both the client and the insurance company, pre-approval of certain expenditures as required, as well as invoicing in the manner set forth in the Litigation Budget Plans. These guidelines, however, set only the baseline for communications. Our case management approach mandates more frequent communications, in order to keep the insurance company representatives timely apprised of key events. Recognizing that this level of communication is key to proper claim analysis and establishment of claim reserves, our insurance companies partners welcome this interaction, as do we.
The Professional Liability Practice Group is led by Andrew Seiden, who has over twenty years of litigation experience in this area and has been personally involved in some of the most significant appellate decisions on legal malpractice in Florida.
